TERMS AND CONDITIONS

Confirmation:
All hire orders taken verbally or otherwise shall be confirmed as soon as possible with a company confirmation number. Sale orders should be confirmed in writing by the customer.

Substitution:
Should a substitute be required to fill an order, this shall be relayed to the customer prior to dispatch.

Cancellation:
Hire orders can be cancelled without penalty if done 72 hours prior to the despatch date. Sale orders can be cancelled up to 7 working days after placing them if not already shipped, refunds will be given at the discretion of the management.

Delivery:
Hire delivery outside the United Kingdom and Northern Ireland is chargeable both outward bound and inward bound. Returns may be at the cost locally of the customer.

Payment:
The customer shall pay the price of the goods on hire or for sale and any other charges in the terms of the contract together with the VAT, free of all deductions or any set-off to the company.
Payment is processed online through PayPal (terms and conditions are available on the PayPal site). Receipt for payment or VAT invoice will only be issued on request.
Any charges involved in collection of outstanding debts whether Court proceedings, Legal, Debt collection or other means shall be to the customer's cost and will be charged to customer's account accordingly.
Accounts exceeding 30 days after invoice shall be placed on hold.
Payment can be made by cash, cheque or bank transfer

Prices:
The companies prices and charges on this site are submitted in good faith and are valid for 30 days.
The company reserves the right to vary prices at their discretion to take account of any variation in labour, materials and other costs.
All prices quoted are inclusive of VAT at the current UK rate.
Note:Prices for hire include Accidental Waiver Damage insurance

Carriage/Delivery:
Orders are delivered by the regular postal services or courier Monday to Friday.
Express and weekend deliveries attract a surcharge.
Individual Hire and groups of items are charged courier delivery. Return delivery is at the cost of the customer.
Non delivery of goods due to a failure in the courier service shall be credited.
Although the company will use all reasonable efforts to meet any delivery dates quoted, such dates are not of essence of the contract and the company shall not be liable to the customer for any loss or damage, incidental or consequential, if delivery of the goods is delayed.

Title:
Until the buyer has paid the company the full purchase price of the goods under Contract (plus any other charges agreed at time of purchase/hire) and also for any goods at the time supplied by the company and all other sums due or to become due to or liabilities, present, future or contingent of the Buyer to the company, the ownership of the goods shall not pass to the buyer.

Force Majeure:
The company will not be liable to the buyer for any breach of contract arising from or which may have been caused by Act of God, by Force Majeure, by War, Riot or Civil commotion and by military or usurped power, by Government order, direction or legislation, by Fire, Accident, Strike or industrial action, Lock out, Adverse weather conditions, delays in transport or any other matter over which the Company has no control.

Warranties/Liabilities:
The company warrants that goods are manufactured with all reasonable care and skill and where applicable comply with the standard specifications set out in the companies published/ on line literature in relation to the goods current at the date hereof and made available to the buyer and that the goods are of merchantable quality.
Save as aforesaid, all other conditions, guaranties, warranties whether expressed or implied by statute common law or otherwise including ( but without prejudice to the generality of the foregoing) conditions whether known or made known to the company or not, are hereby excluded. The company shall not be liable for any change in appearance, durability and performance or for any defect caused to the goods by the customer subsequent to the purchase from the company.

Returns (Retail Purchase):
Returned purchased goods will only be accepted upon written authorisation by the company.
Refunds will be given at the discretion of the management.
Where goods are found to be faulty, the company will at its option either credit the goods or replace the goods provided that;
A) The goods are returned to the company carriage paid, unused within 28 days of purchase, and that
B) The companies invoice, receipt or proof of purchase relating to the goods has been enclosed,
C) The company would be entitled to reject them.

Returns (Hire):
Return of Hired goods must be as per agreed booking contract, either immediately after the initial hire period or after any pre-booked extension to that initial period. (Provided written confirmation has been given to the customer by the company) Late returns will be charged at £5.00 per outfit per day or part thereof; for a maximum total hire period of 30 days, thereafter should the hire package/s not be received back at Highland Dress Hire, at that time. The hire shall be deemed none returned and the customer shall be billed at the total cost of the package/s as new (prices will be charged at the current rate on this site).

Governing Law:
This Contract shall be governed and constructed in accordance with the Laws of England and Wales the parties hereby prorogate the non-exclusive jurisdiction of the County Court.
